Welcome to PlungePalz, owned and operated by PlungePalz LLC ( "Company," "we," "us," or "our"). These Terms of Use ("Terms") govern your use of the PlungePalz mobile application and any related websites, services, or products (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Services immediately.
We may revise these Terms at any time. If we make material changes, we will notify you via email or through the Services before the new terms take effect. Your continued use of the Services after any changes indicates acceptance of the revised Terms.
You must be at least 18 years of age to use the Services. By using our Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding contract.
You agree to abide by our Community Standards, which are incorporated into these Terms by reference. Violation of these standards may result in suspension or termination of your account.
All content, features, and functionality of the Services, including but not limited to text, graphics, logos, and software, are owned by PlungePalz LLC and are protected by copyright, trademark, and other intellectual property laws.
You retain ownership of content you upload but grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content in connection with the Services.
You may not copy, modify, distribute, sell, or lease any part of our Services without our written permission.
Our rewards program allows you to earn points for various activities. Points have no cash value and cannot be transferred.
Points may be redeemed for rewards as available. We reserve the right to modify or discontinue the rewards program at any time.
Points may be forfeited upon account termination or violation of these Terms.
IMPORTANT: Cold plunging and other wellness activities can be dangerous. The Services are for informational and tracking purposes only and do not constitute medical advice.
You should consult with a qualified healthcare professional before beginning any cold exposure therapy or wellness program. We disclaim all liability for any health-related consequences of using our Services or following any advice or information provided through the Services.
The Services allow you to optionally connect third-party accounts, including Strava, Garmin Connect, Oura, and Apple Health. All such connections are voluntary and may be disconnected at any time. PlungePalz is fully usable without connecting any of them, and we do not charge any fee for connecting to, accessing, or using any third-party integration. Integration functionality is available to all PlungePalz users regardless of subscription status.
Your use of each connected platform remains subject to that platform's own terms of service and privacy policy. Nothing in these Terms modifies, conflicts with, or supersedes the terms of any third-party service provider. In the event of a conflict between these Terms and a third-party service provider's terms with respect to that provider's data, the third-party terms control.
Data obtained from the Strava API is displayed only to the Strava account holder within PlungePalz. It is not shown to other users, not used by the PlungePalz AI Advisor or Wellness Score, not used for advertising, and not retained for longer than seven days. PlungePalz is not affiliated with, endorsed by, or sponsored by Strava, Inc. Your use of Strava remains governed by the Strava Terms of Service and Strava Privacy Policy.
Third-party platforms may modify, restrict, or discontinue API access at any time and without notice to us. We may suspend or remove an integration as a result, and we are not liable for any such change.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
THIS DISCLAIMER IS MADE BY PLUNGEPALZ LLC ON ITS OWN BEHALF AND ON BEHALF OF EACH THIRD-PARTY SERVICE PROVIDER WHOSE SERVICES ARE INTEGRATED WITH OR ACCESSED THROUGH THE SERVICES, INCLUDING WITHOUT LIMITATION STRAVA, INC., GARMIN LTD., OURA HEALTH OY, APPLE INC., AND AMAZON WEB SERVICES, INC. EACH SUCH THIRD-PARTY SERVICE PROVIDER EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, WITH RESPECT TO THE SERVICES AND ANY DATA OR FUNCTIONALITY MADE AVAILABLE THROUGH THEIR RESPECTIVE PLATFORMS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLUNGEPALZ LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL ANY THIRD-PARTY SERVICE PROVIDER — INCLUDING WITHOUT LIMITATION STRAVA, INC., GARMIN LTD., OURA HEALTH OY, APPLE INC., AND AMAZON WEB SERVICES, INC. — BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, PUNITIVE, INDIRECT, OR INCIDENTAL DAMAGES OF ANY KIND ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, ANY THIRD-PARTY INTEGRATION, OR ANY DATA MADE AVAILABLE THROUGH THEM, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS EXCLUSION APPLIES TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
You agree to indemnify, defend, and hold harmless PlungePalz LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or relating to your use of the Services, your violation of these Terms, or your violation of any rights of another.
You may terminate your account at any time by following the account deletion process in the Services.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if we reasonably believe you have violated these Terms.
Upon termination, your rights to use the Services will cease immediately, and any PlungePoints or rewards may be forfeited.
These Terms shall be governed by the laws of the State of California, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in Orange County, California, except that either party may seek injunctive relief in any court of competent jurisdiction.
We reserve the right to update these Terms at any time. If we make significant changes, we will provide you with advance notice via email or by posting the changes through the Services. Continued use of the Services following the effective date of any changes indicates your acceptance.
